1. Who We Are
OmniServe Texas LLC ("OmniServe," "we," "us," or "our") is a Texas limited liability company providing notary, document preparation, certified translation, identity verification, tax preparation, IFTA filing, pool chemical, ISO consulting, and related professional services in the Houston/Pearland metropolitan area and via Remote Online Notarization (RON) nationwide.

2. Sensitive Data — We Require Opt-In Consent
Because our identity verification and notary services may involve the collection of biometric data, health information (medical POA), immigration and citizenship status, and government-issued identity documents, these are classified as sensitive personal data under the Texas Data Privacy and Security Act (TDPSA §541.002) and federal law. We collect this data ONLY with your explicit, prior opt-in consent. You may withdraw consent at any time.
3. What We Collect and Why
- Identity & Contact Information: Name, address, phone, email — required to provide services and comply with Texas notary journal requirements (Texas Gov't Code §406.014)
- Government-Issued ID: Driver's license, passport, or equivalent — required by law to verify identity for every notarial act
- Biometric Data (IDVerifyPro only): Facial liveness check for remote identity verification — requires separate opt-in; never stored beyond the verification session without consent
- Financial Information: Payment card data (processed by Stripe/Square — we do not store card numbers), tax return information, IFTA mileage and fuel records
- Immigration Status: Collected only for immigration document assistance — never shared without explicit consent
- Website Usage: Analytics cookies (Google Analytics or similar) — only with your consent; we honor Global Privacy Control (GPC) signals
- Communications: Messages sent via our contact form, SMS (Twilio), or email — retained for service delivery and regulatory compliance
4. Legal Basis for Processing
- Contract performance: Processing necessary to deliver the service you requested
- Legal obligation: Texas notary law requires identity verification and journal records; FCRA requires adverse action notices for tenant screening reports
- Explicit consent: Sensitive data (biometric, health, immigration status) — collected only after affirmative opt-in
- Legitimate interest: Fraud prevention, security, and service improvement — subject to your right to object
5. How We Share Your Data
We do not sell your personal information. We share data only as follows:
- Service providers: n8n (workflow automation), Stripe/Square (payment processing), Twilio (SMS), SendGrid (email), Airtable (appointment management), Anthropic Claude API (AI features) — all under data processing agreements
- IDVerifyPro / Atronus Technologies: Identity verification processing — only with your consent
- Government agencies: IRS (tax filings), Texas Secretary of State (notary acts), USCIS (immigration assistance) — as required by law
- Legal requirements: Court orders, subpoenas, or law enforcement requests where legally required
6. Your Texas Privacy Rights (TDPSA)
- Right to Access: Know what personal data we hold about you
- Right to Correction: Correct inaccurate data
- Right to Deletion: Request deletion of your personal data
- Right to Data Portability: Receive your data in a portable format
- Right to Opt Out: Opt out of targeted advertising or sale of personal data (we do not sell data)
- Right to Appeal: If we deny a request, you may appeal within 60 days
Submit a Data Subject Access Request (DSAR): Email info@omniservetexas.com with subject line "DSAR Request." We respond within 45 days. No fee for up to two requests per year.
7. Data Retention
- Notary journal records: 10 years (Texas Gov't Code §406.014)
- Tax records: 7 years (IRS requirements)
- Identity verification session data: 30 days unless subject to legal hold
- Marketing data: Until you opt out or request deletion
8. Security
We use industry-standard safeguards: TLS encryption in transit, encrypted storage, access controls, and regular security reviews. Our AI and workflow systems use Anthropic Claude API with zero-retention data processing agreements. Payment processing is handled exclusively by PCI-DSS certified providers (Stripe, Square). We do not store full payment card numbers.
9. Cookie Policy
- Essential cookies: Required for the website to function (session management, security). Always active. No consent required.
- Functional cookies: Remember your language preference and form progress. Opt-in.
- Analytics cookies: Measure how visitors use our site (anonymized). Opt-in. We honor Global Privacy Control (GPC) browser signals.
- Sensitive/Identity cookies: Used during IDVerifyPro identity verification sessions. Explicit opt-in required before any biometric data collection.
10. Children's Privacy
Our services are not directed at children under 13. We do not knowingly collect personal data from children under 13. Childcare POA services are provided to parents and guardians — child data is collected only as required to deliver the requested notary service.
